USER AGREEMENT
"AGREEMENT"

By accessing and using this site, you (“User”) acknowledge and accept that you have read and understand and are bound by the contents of the terms and conditions contained hereunder which apply to the use of this site. If you do not understand or agree with, or do not wish to bound by, any of these terms and conditions, you may not access or use this site. Please check these terms and conditions periodically for changes as the owner of this site ("Blue Vision Dive Centre") reserves the right to revise your continued use of this site and any changes would constitute the status of the standing terms and conditions. Blue Vision Dive Centre reserves the right to forbid a User's use of this site other than those stipulated under this Agreement. Blue Vision Dive Centre reserves the right to modify, enhance, discontinue and further develop the site or its contents at any time without prior notice to the User.

PERMISSION TO USE THIS SITE

Upon your acceptance of this Agreement, Blue Vision Dive Centre hereby grants you a non-exclusive, non-transferable permission to use this site as according to the instructions on this site. You acknowledge that all products and services available on this site are property of Blue Vision Dive Centre. All content, trade marks and data on this site, including but not limited to text, graphics, logos, hyperlinks, designs, are the property of Blue Vision Dive Centre and, as such, are protected from infringement by national and international laws. All rights not expressly granted here are the preserve of Blue Vision Dive Centre, its advertisers and regulators. Where permission to use the site content has been granted, you shall always credit Blue Vision Dive Centre on every occasion that the material is used.

Blue Vision Dive Centre shall under no circumstance be held responsible for any injury, loss, expense or damage of any kind whatsoever suffered or incurred by any person who accesses or uses this site, utilising any information or service offered on this site, or relying on any information contained on this site for any reason whatsoever, including but not limited to any injury, loss or damage suffered as a result of errors in the information provided; any unauthorised access of this site by third parties; any breakdown or failure of any medium of access to this site; any failure or unavailability of any of Blue Vision Dive Centre’s or any third party’s facilities resulting in the inability to access this site or use any information referred to or offered on this site; any alteration, upgrade or update of this site or any technology, hardware or software modification that may form part of this site.

APPLICABLE LAW

The laws of the Republic of South Africa govern this contract. The User fully acknowledges that any dispute resulting in legal intervention shall be concluded within the jurisdiction of South Africa and that the applicable laws of South Africa shall prevail.

Blue Vision Dive Centre may provide links to the User only as a convenience and the inclusion of any link on this site does not imply Blue Vision Dive Centre’s endorsement of such sites. Blue Vision Dive Centre shall not be held responsible or liable in any way for the contents, use or inability to use or access any linked sites or any links contained in a linked website.

PRIVACY POLICY

No personal information will directly be disclosed to third parties without the User’s consent. Blue Vision Dive Centre gathers and will be in possession of the following private information of users;

1. information provided by the User voluntarily;
2. information automatically provided (inter alia by way of cookies).

By using this site, the User agrees to the following:

1. Blue Vision Dive Centre may use the User’s personal information to communicate with the User from time to time. The User may, however, indicate to Blue Vision Dive Centre that he/she/it does not wish to receive such communications from Blue Vision Dive Centre;
2. Blue Vision Dive Centre may use a User’s information for statistical purposes;
3. Blue Vision Dive Centre shall not be held liable for risks incurred through the use of this site as well as risks associated with data security, privacy and transmission.
